PÖFF Club Rules
Valid from 1 September 2018

The PÖFF Club aka Wolf Pack is a loyalty programme of non-profit association MTÜ Pimedate Ööde Filmifestival, registry code 80044767, address Telliskivi 60a, 10412 Tallinn, which provides discounts and special offers to PÖFF Club members. MTÜ Pimedate Ööde Filmifestival retains the right to change the terms and conditions of the loyalty programme at any time without notification. Users who wish to remain anonymous will not be able to use the discounts offered to members.
1. Joining
In order to join the PÖFF Club, you need to register on the PÖFF homepage (https://poff.ee), by which you confirm that you have reviewed and agree to the terms and conditions of MTÜ Pimedate Ööde Filmifestival and agree to the processing of your personal data in accordance with the procedure established in the Privacy Policy. A contract shall enter into force between the PÖFF Club member and MTÜ Pimedate Ööde Filmifestival in accordance with these terms and conditions.
Persons of at least 18 years of age (or children with parental consent) may join the PÖFF Club called Wolf Pack and joining is free of charge. Joining the Wolf Friend Package and the Wolf Pass is for a fee. The fee can be paid via a bank link or bank transfer. Enter MTÜ Pimedate Ööde Filmifestival as the recipient of the payment. The joining fee includes VAT 20%. Upon joining the PÖFF Club, the new member shall immediately receive user guidelines and a confirmation letter to the e-mail address designated by him/her. The letter also contains a unique code which will be used to identify the new member.
2. Membership
The members of the Wolf Pack are on the basis of their chosen package divided into three groups:
  • Wolf Pack members
  • Wolf Friends
  • Wolf Pass holders

The Wolf Friend Package and the Wolf Pass provide membership for a limited period of time, i.e. just for the duration of one festival. On 1 January, the level of the Wolf Friend Package and Wolf Pass holders drops to the Wolf Pack status level. All those who wish can order a new package for the subsequent festival on the basis of the price list applicable during the respective season. The packages and prices are reviewed prior to every festival, considering their usage statistics and the feedback received from clients.
A PÖFF Club account is personal and it is forbidden to give it for another person to use.
A PÖFF Club member is identified at PÖFF sales points on the basis of a personal barcode and the photo submitted upon joining the PÖFF Club. The Wolf Pass holders are identified on the basis of a badge. The Wolf Friends and Wolf Pass holders are also identified before entry to cinema halls. If a person cannot be identified, the discount shall not apply and the person has to pay the difference up to a full-price ticket at the PÖFF ticket office.
3. Privileges and discounts
The following privileges and discounts apply to PÖFF Club members:
  • More favourable prices for PÖFF cinema tickets
  • Opportunity to purchase tickets 24h prior the official sales (Wolf Friends and Wolf Pass owners)
  • Drawing up YOUR OWN PROGRAMME
  • Personalised film recommendations based on chosen keywords
  • Rating of films
  • Special offers from partners and prize draws

You can find information about the currently valid discounts on the PÖFF homepage (https://poff.ee) and, during the advance sales period and the festival, at the PÖFF information points.
Before making a purchase, PÖFF Club members have to present a badge in order to get a discount. Upon making a purchase on the webpage, members have to log in. Discount is no longer applied after the purchase of tickets at the ticket office or from Piletilevi via the Internet.
4. Gift code
You can give Wolf Friend or Wolf Pass membership as a gift to another person. A gift code is a code with which another person can receive a package corresponding to the code while joining the Wolf Pack. The purchaser of a gift code will receive the Gift Code to their e-mail after making the purchase and can then forward the Gift Code to their chosen person. A Gift Code can only be used by one person upon one occasion.
5. Termination of contract
A PÖFF Club member shall have the right to terminate his/her Club membership at any time. The contract can be terminated by clicking on the relevant link under your account settings or by sending a relevant request by e-mail to hundikari@poff.ee.
Upon termination, you will no longer be able to use the privileges and discounts intended for Club members. A client will no longer be able to log into his/her PÖFF account and all the data related to the client shall be deleted and the procedure is irrevocable.
If a client has a Wolf Pass badge, the badge will also become invalid and will no longer grant discounts and rights to the client.
MTÜ Pimedate Ööde Filmifestival retains the right to terminate the contract with a client if the client fails to comply with the terms and conditions of the contract or misuses his/her rights.

The General Terms and Conditions
Valid from 1 September 2018

The General Terms and Conditions apply to ordering the products and services offered on the homepage of non-profit association MTÜ Pimedate Ööde Filmifestival, registry code 80044767, address Telliskivi 60a, 10412 Tallinn (hereinafter PÖFF) at https://poff.ee (hereinafter the Homepage). In addition to these General Terms and Conditions, the relations between the Client and PÖFF are regulated by the procedure of processing the personal data of clients (the Privacy Policy), the pricelist of products offered on the Homepage, and the legal standards and the good practices applicable in the Republic of Estonia. The PÖFF cinema tickets are purchased via the system of Baltic Ticket Holdings AS and the general principles of personal data processing of Baltic Ticket Holdings AS apply, available at https://www.piletilevi.ee/eng/generalinfo/aboutus/Privacyprinciples/.
You can review these General Terms and Conditions, the Privacy Policy and the products and services pricelist on the PÖFF Homepage.
1. Ordering products and services
  • In order to order products and services, a Client has to register as a user of the PÖFF Internet environment.
  • Orders can be placed in Estonian and in English.
  • A Client chooses a desired product or service on the Homepage and adds it to the shopping cart. Before the final confirmation of the order, the Client can check and change his/her order. After checking the order, the Client confirms the order, chooses the most convenient payment method and pays for the order.
  • All the prices of products and services indicated on the Homepage are in Euros and inclusive of VAT, except for donations.
  • The ordered products and services can be paid for by using a bank link or bank transfer.
  • A contract between the Client and PÖFF is considered concluded with the Client has confirmed the order and PÖFF has sent the Client an order confirmation.
  • PÖFF is a personal data controller. Necessary personal data for payment execution purposes is transmitted to the data processor Maksekeskus AS.
2. Delivery of products
  • Detailed information concerning the delivery of products is sent to the Client’s e-mail address after the confirmation of the order.
  • If a Client has ordered a Wolf Pass, the Client is issued a personal badge which contains the Client’s given name and surname, the Client’s badge type and portrait photo. Badges can be retrieved at the PÖFF information point at Coca-Cola Plaza during the festival or during the advance sales period (dates posted on the Homepage).
  • No badges are issued upon ordering the Wolf Friend Package.
3. Withdrawal from orders
  • The right to withdraw a purchase is not applied to a contract that deals with the provision of the service, if The Festival’s obligations stipulated in the contract have been fully complied and the provision of the service has been initiated by a clear approval of the client and a confirmation that he/she will lose the right to withdraw in case The Festival has complied with the contract. This also applies to contracts dealing with the service of leisure time activities, in case The Festival has been obliged in the aforementioned contract, to provide the service before a certain date or during a certain time period.
  • If a Client has not yet acquired any tickets under the Festival Pass or the Wolf Friend Package, the Client has the right to transfer the service to another person until the completion of the badge, by giving prior notice thereof to PÖFF by e-mail to hundikari@poff.ee.
  • In case of an exception, the consumer shall bear the direct costs relating to the return of the goods delivered to the consumer as the object of contract.
4. Registration
  • In order to become a regular client of PÖFF, a Client has to register at https://poff.ee. You can also register via your Facebook or Google account.
  • In order to register, you need to complete all the mandatory fields on the form.
  • After registration, the instructions for confirming the account shall be to the e-mail provided by the Client.
  • After activating the account, the Client will be able to use his/her e-mail address and his/her chosen password to log into the PÖFF Internet environment and join the Wolf Friend Package, become a pass holder, start preparing YOUR OWN PROGRAMME, receive personalised film recommendations and start rating films.
5. Rights of Clients
  • Clients shall have the right to order products and services in the Internet environment at the prices determined by PÖFF.
  • Products received by Clients must meet the requirements presented on the Homepage.
  • In the event of non-conformity of a product or service, Clients shall have the right to rely on legal remedies established by the law.
6. Obligations of Clients
  • Upon preparing an order, Clients shall be obligated to present the data necessary for placing an order: given name and surname, e-mail address, phone number, country, birthday, sex, portrait photo (for the Wolf Pass or Wolf Friend Package).
  • If the data presented by a Client are faulty and/or incomplete, MTÜ Pimedate Ööde Filmifestival cannot guarantee that the order will be fulfilled. Upon discovering an error or incomplete data, Clients shall have to contact PÖFF in order to update and/or correct the data.
  • Upon placing an order, Clients confirm that they agree to these General Terms and Conditions and undertake to comply therewith.
  • If a Client notices suspicious activities on his/her account, the Client shall be obligated to immediately notify MTÜ Pimedate Ööde Filmifestival thereof.
7. Rights of MTÜ Pimedate Ööde Filmifestival
  • PÖFF shall have the right to amend these General Terms and Conditions without prior notification. The new applicable terms and conditions shall be published in the Internet environment.
  • PÖFF shall have the right to change the prices of the products and services offered via the Internet environment at any time. The new prices shall be published in the Internet environment.
  • PÖFF shall have the right to refuse to fulfil an order, if an incorrect price has been mistakenly indicated for a product or service.
  • If a Client fails to fulfil the obligations established in these General Terms and Conditions, PÖFF cannot guarantee that the order will be fulfilled and shall have the right to delete the Client’s account.
8. Obligations of MTÜ Pimedate Ööde Filmifestival
  • PÖFF shall be obligated to ensure delivery of products or services that meet requirements to the Clients.

Privacy Notice
This Privacy Notice describes how non-profit association Pimedate Ööde Filmifestival (registry code 80044767, address Telliskivi 60a, Tallinn 10412, Republic of Estonia; hereinafter we or PÖFF) processes personal data.

We may process your personal data within the framework of various processes and relationships, depending on how you are associated to us. This Privacy Notice is divided into different parts on the basis of the different situations in which we may need to process your personal data. In order to obtain an accurate overview of the personal data processing principles that concern you, kindly find the part(s) below which apply to your connection with to PÖFF (section 1 of the Privacy Notice). In addition, please review our general principles of processing personal data provided at the end of this Privacy Notice which describe the principles that are generally applied to our personal data processing activities (sections 2 to 8 of the Privacy Notice). 

The terms and definitions used in the Privacy Notice should be construed as in the General Data Protection Regulation of the European Union (Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation; hereinafter GDPR). ‘Film Festival’ means the different film festivals organised by PÖFF (the Black Nights Film Festival, the youth and children’s film festival Just Film, the short films festival PÖFF Shorts, the film industry platform Industry@Tallinn, the Haapsalu Horror and Fantasy Film Festival, the Tartu Love Film Festival tARTuFF, the Kumu Documentary). ‘Industry’ means the film industry platform Industry@Tallinn. ‘Eventival’ means the film festival management portal at https://www.eventival.com/.
1. Categories of personal data, purposes and legal bases of processing, and storage of personal data
1.1. I am an invited or registered guest of the Film Festival and/or Industry
In the meaning of this Privacy Notice, ‘invited or registered guests’ of the Film Festival and Industry include all the persons who have received an accreditation from PÖFF to attend the Film Festival and/or Industry or are applying for the accreditation (including film guests, people accompanying film guests, the press, jury members, persons who have submitted a film to the Film Festival, the film industry guests).

We may process the following personal data related to you (the categories of personal data may vary depending on which data you have decided to forward to us):
  • personal details (given name and surname, date of birth, sex, languages);
  • contact details (e-mail address, phone number);
  • photo;
  • employment related data (country, position, area, profession);
  • payment data.

If we make transport and accommodation bookings for you under an agreement with you, we may additionally process the following personal data:
  • personal identification document data;
  • address;
  • details of transport and accommodation services (e.g. route, duration); 
  • other data which you have forwarded to us for that purpose (e.g. information concerning food intolerances, information concerning physical special needs).
As a rule, we collect your personal data from you and store these under your profile in Eventival. You may also create an Eventival account and add and change data there yourself. Your Eventival account will be linked to your Eventival profile. In order to simplify the creation of an account for you, we may, with your consent, create an account for you, adding the necessary personal data from your profile. If you have given us your consent for the creation of an Eventival account, we shall, after pre-completing the account, give you access to the Eventival user account, which allows you to manage the personal data on your account (allows you to choose your password). Upon pre-completing the profile and the account or for the purpose of establishing first contact with you, we may also collect your name, contact details and employment data from public sources (Google, LinkedIn, Cinando, the websiteof your organisation).

We process your personal data for the following purposes and on the following legal bases:
  • we process your personal data (name, contact details, employment information) in order to contact you and invite you to the Film Festival and/or Industry, in which case the legal basis for processing is our legitimate interest to invite you to attend the event and thereby increase the quality and attractiveness of the Film Festival and/or Industry, which in our assessment overrides your interests and fundamental rights and freedoms (Article 6 (1)(f) of the GDPR), particularly considering that this is your employment-related information and it is also in the interest of your professional activities;
  • we process your personal data (personal details, contact details, employment information, photo, payment data) in order to allow you to visit the Film Festival and/or Industry, including for the purpose of issuing you the badge with a photo necessary for that purpose and to contact you in connection with the event, in which case the legal basis for processing your personal data is the performance or entry into our mutual contract under which you have received an accreditation to attend the Film Festival and/or Industry (Article 6 (1)(b) of the GDPR);
  • we process your personal data in order to organise transport and accommodation services for you (if we have made a relevant agreement), in which case the legal basis for processing your personal data is the performance of our mutual agreement (Article 6 (1)(b) of the GDPR);
  • we process your personal data (personal details, contact details, employment information) in order to offer you a personal reception upon your visit to the Film Festival and/or Industry (unless you are accompanying a film guest), in which case the legal basis for processing is our legitimate interest to do so in order to thereby increase the quality and attractiveness of the Film Festival and/or Industry, which in our assessment overrides your interests and fundamental rights and freedoms (Article 6 (1)(f) of the GDPR), particularly considering that this is your employment related information;
  • we process your personal data (name, contact details, employment information, photo) for printing Industry Guide distributed to the participants of Industry and for preparing the online Eventival catalogue Who Is Here (unless you are accompanying a film guest), in which case the legal basis for processing is our legitimate interest to thereby increase the quality and attractiveness of the Film Festival and/or Industry, which in our assessment overrides your interests and fundamental rights and freedoms (Article 6 (1)(f) of the GDPR), particularly considering that this is your employment related information, you have control over the data being printed and it is also in the interest of your professional activities;
  • we process your personal data for the fulfilment of our obligations arising from legal acts (Article 6 (1)(c) of the GDPR);
  • if necessary, we process your personal data for filing claims and for defending ourselves against claims, in which case the legal basis for processing is our interest to do so, to the extent that in our assessment overrides your interests and fundamental rights and freedoms (Article 6 (1)(f) of the GDPR).
The data of film guests and jury members (name and employment information) are also disclosed in connection with the Film Festival on PÖFF’s webpage and in other sources. The legal basis for the disclosure is our legitimate interest to provide sufficient information about the Film Festival, which in our assessment overrides your interests and fundamental rights and freedoms (Article 6 (1)(f) of the GDPR), particularly considering that this is your employment related information and it is also in the interest of your professional activities.

We store your personal data until it is necessary depending on the objective for which we collected the data. We may store your personal data longer, if it is necessary for the protection of our interests or the fulfilment of our obligations deriving from the law. For instance, we store personal data necessary for the fulfilment of accounting obligations for at least 7 years from the end of the relevant financial year, and we store personal data necessary for filing claims or defending ourselves against claims for 10 years.
1.2. I am a guest who has bought a ticket to the Film Festival
If you are a guest who has bought a ticket to the Film Festival, we generally do not process your personal data, as tickets are not personalised. We may process your personal data (name, contact details) if, for instance, you take part in audience voting. In such case the legal basis for processing is your consent (Article 6 (1)(a) of the GDPR). Please note that you have the right to withdraw your consent at any time by giving notice of your wish to info@poff.ee. The withdrawal of the consent does not affect the lawfulness of the processing performed on the basis of the consent before the withdrawal thereof. We store your personal data until necessary for the objective for which we collected the data.
1.3. I am a member of the loyalty programme Wolf Pack (PÖFF Club)
In the meaning of this Privacy Notice, ‘memers of the loyalty programme’ include all the persons who have joined the loyalty programme Wolf Pack by creating a user on PÖFF’s webpage or by registering as a loyalty programme member at a PÖFF information point.
We process the following personal data related to you:
  • given name and surname;
  • e-mail address;
    phone number;
    country;
    birthday;
    sex;
  • photo (if you certify your identity via Google or Facebook and you have a profile photo there which you agree to share with us) or portraitphoto (for Wolf Pass or Wolf Friend package);
  • user account login data;
  • your activities as a loyalty programme member (e.g. chosen keywords, ticket purchase history, films rated by you and the rating given).

We process your personal data for the following objectives and on the following legal bases:
  • we process your personal data in order to allow you to use various functions of the loyalty programme, including to allow you to prepare a film programme of your preferred films and for us to offer you film recommendations on the basis of your chosen keywords as well as discount offered by us and/or our cooperation partners, in which case the legal basis for processing is the performance of our mutual agreement(Article 6 (1)(b) of the GDPR);
  • we process your personal data for the fulfilment of our obligations arising from legal acts (Article 6 (1)(c) of the GDPR);
  • if necessary, we process your personal data for filing claims and for defending ourselves against claims, in which case the legal basis for processing is our interest to do so, in the extent that in our assessment in such case overrides your interests and fundamental rights and freedoms (Article 6 (1)(f) of the GDPR).
We store your personal data until it is necessary depending on the objective for which we collected the data. We may store your personal data longer, if it is necessary for the protection of our interests or the fulfilment of our obligations deriving from the law. For instance, we store personal data necessary for the fulfilment of accounting obligations for at least 7 years from the end of the relevant financial year, and we store personal data necessary for filing claims or defending ourselves against claims for 10 years.
1.4. I am a candidate for the position of an employee or a volunteer
In the meaning of this Privacy Notice, ‘candidates’ include all persons who have expressed their wish to be employed (on the basis of an employment contract or a contract for services) or work as a volunteer at PÖFF.

We process the following personal data related to candidates:
  • given name and surname, date of birth;
  • contact details (e-mail address, phone number, address);
  • information concerning qualification (e.g. information about the acquired education and/or professional qualifications);
  • data about prior work and/or volunteer work experience;
  • other data which you have decided to forward to us in your CV, motivation letter or otherwise.

We process your personal data for the following objectives and on the following legal bases:
  • we process your personal data in order to find the most suitable candidates for us with whom to conclude contracts, in which case the legal basis for processing your personal data is to take steps prior to entering into a contract on the basis of your application (Article 6 (1)(b) of the GDPR);
  • we process your personal data in order to offer you vacant positions and opportunities to work as a volunteer in the future, but only if you have given us your consent for that purpose (Article 6 (1)(a) of the GDPR). Please note that you have the right to withdraw the granted consent at any time by giving notice of your wish to the person to whom you forwarded the data or to info@poff.ee. The withdrawal of the consent does not affect the lawfulness of the processing performed on the basis of the consent before the withdrawal thereof;
  • if necessary, we process your personal data for filing claims and for defending ourselves against claims, in which case the legal basis for processing is our interest to do so, to the extent that in our assessment overrides your interests and fundamental rights and freedoms (Article 6 (1)(f) of the GDPR).
As a rule, we store your personal data for 1 year from making the recruitment decision. If you have given us your consent for making work offers in the future, we store your personal data for 5 years or until you withdraw your consent. We may store your personal data longer, if it is necessary for the protection of our interests or the fulfilment of our legal obligations.
1.5. I am a recipient of the newsletter
In the meaning of this Privacy Notice, ‘recipient of the newsletter’ includes all persons who have subscribed to the PÖFF, PÖFF Shorts or Just Film newsletter lists. We forward the PÖFF, PÖFF Shorts and Just Film newsletter to you only with your consent, for the purpose of informing you of various offers, events and our other activities which may be of interest to you. We also conduct surveys at times in order to receive feedback on our services and to develop our services accordingly.

In order to send you the newsletter, we process your given name and surname, e-mail address and the newsletter topic preferences.

You have the right to withdraw the consent granted for sending the newsletter at any time by clicking on the link at the end of the newsletter or by sending an e-mail to press@poff.ee. Please note that the withdrawal of the consent does not affect the lawfulness of the processing performed on the basis of the consent before the withdrawal thereof.

We store your personal data until you ask to be removed from amongst the recipients of the newsletter.
1.6. I am a person who has contacted PÖFF or participated in a draw organised by PÖFF
If you contact us by phone or e-mail or by using other means or participate in any of our campaigns, we may process the data you have made available to us (e.g. name, contact details, the content of the enquiry). In such case, the legal basis for processing personal data is your consent (Article 6 (1)(a) of the GDPR). Please note that you have the right to withdraw the granted consent at any time by giving notice of your wish to info@poff.ee. The withdrawal of the consent does not affect the lawfulness of the processing performed on the basis of the consent before the withdrawal thereof. We store your personal data until necessary depending on the objective for which we collected the data. We may store your personal data longer, if it is necessary for the protection of our interests or the fulfilment of our legal obligations.
2. Transmission of personal data
We share your personal data with third parties only in the case of justified need to the justified extent and only if we have a legal basis to do so.

For instance, in our activities we use the following service providers who may get access to your personal data (data processors): Eventival, Google, e-mail service provider, accounting software provider, payment platform provider, film screening platform provider, IT service providers; and, in the case of the invited guests of the Film Festival and Industry, our contractors and volunteers. We only use processors who provide sufficient guarantees that they apply appropriate technical and organisational measures in order to ensure the protection of your personal data. For that purpose, we have concluded appropriate data processing agreements with them and remain responsible for ensuring the protection of your personal data.

We may also transmit your personal data to the following third parties who act as independent controllers with regard to your personal data:
  • to the recipients of PÖFF’s reports, such as film producers, the media, the Ministry of Culture, the Tallinn City Office. The reports contain the name and professional information of the invited guests of the Film Festival and Industry (excluding the persons accompanying the film guests). The legal basis for the transmission is our legitimate interest to prove to the stakeholders related to the organisation of the Film Festival and Industry who took part in the Film Festival and Industry and what is the grasp of the Film Festival and Industry, which in our assessment overrides your interests and fundamental rights and freedoms (Article 6 (1)(f) of the GDPR), particularly considering that this is your professional information;
  • to Enterprise Estonia for the fulfilment of our obligations arising from legal acts to submit the data of foreign guests in connection with the certification obligation arising from the receipt of marketing support for large-scale events (Article 6 (1)(c) of the GDPR);
  • if appropriate, to third parties via whom transport and accommodations services are organised for the invited guests of the Film Festival and Industry, in which case the legal basis for transmission is the fulfilment of our mutual agreement (Article 6 (1)(b) of the GDPR);
  • to third parties who organise events within the PÖFF Film Festival and Industry for the Film Festival and the Industry guests, participation in which is based on personal invitations or a guest list, in which case the legal basis for transmission is your consent (Article 6 (1)(a) of the GDPR);
  • to third parties who are involved in the protection of our rights (e.g. legal consultants), in which case the legal basis for the transmission of personal data is our legitimate interest to the extent which in our assessment overrides your interests and fundamental rights and freedoms (Article 6 (1)(f) of the GDPR);
  • to third parties to whom we are obligated to transmit personal data in accordance with the law or other legal acts (e.g. auditors, supervisory authorities), in which case the legal basis for transmission is the fulfilment of our obligations arising from the law (Article 6 (1)(c) of the GDPR).
3. Transmission of personal data outside the European Union

6. Amendment of Privacy Notice
